The Competition Committee has been consistently implementing measures to support national brands, protect the legitimate interests of entrepreneurs, and prevent acts of unfair competition.
In particular, during the review conducted based on the application of Xorazm Profi School LLC, it was established that the use of the social media page “nexus_maktab” and the designation “Nexus International School” by Nexus School Non-Governmental Educational Institution was likely to mislead consumers and negatively affect the business reputation of a competitor.
Furthermore, during the review conducted based on the application of Bilimintertrans LLC, it was established that the company name Bilim Trans School LLC is confusingly similar to the trade name Bilimintertrans. It was noted that this situation could mislead consumers when choosing a service provider and negatively affect a fair competitive environment.
Based on the above, proceedings were initiated against Nexus School Non-Governmental Educational Institution and Bilim Trans School LLC in accordance with the established procedure on the grounds of alleged violations of Article 21 of the Law of the Republic of Uzbekistan “On Competition”. Financial fines were imposed, and binding orders were issued requiring the elimination of the violations and preventing their recurrence.
As a result of the measures taken, the trademark rights of Xorazm Profi School LLC and Bilimintertrans LLC were restored, their legitimate interests were protected, and acts of unfair competition were brought to an end.
We remind that, pursuant to Article 21 of the Law of the Republic of Uzbekistan “On Competition”, misleading consumers through the use of signs similar to a competitor’s trade name, goods, works or services, making unfair comparisons, or committing actions that damage a competitor’s business reputation constitutes unfair competition and is prohibited by law.
