LEGAL VIOLATIONS IDENTIFIED IN PUBLIC PROCUREMENTS WORTH OVER UZS 25 BILLION, WITH APPROPRIATE MEASURES TAKEN
The Competition Promotion and Consumer Protection Committee of the Republic of Uzbekistan continues to ensure transparency and fair competition in the field of public procurement through continuous monitoring and the review of appeals. Appropriate enforcement measures are being taken by the Committee’s territorial bodies in relation to identified violations.
In particular:
📍Jizzakh Region:
As a result of monitoring conducted by the territorial administration using data from specialized electronic information portals, legal violations were identified in public procurements with a total value exceeding UZS 1.5 billion.
In particular, violations were identified in tenders involving outsourcing services worth UZS 588.3 million at the Arnasay District Medical Association; procurement of goods and material assets worth UZS 333.1 million across 6 tenders at the Regional Specialized Boarding School of Arts; outsourcing services worth UZS 420.0 million at the Tuberculosis Dispensary; and procurement of construction materials worth UZS 183.1 million by the Dustlik District Department of Preschool and School Education.
Due to violations of the requirements of Article 29 of the Law “On Competition”, resulting from the imposition of unjustified requirements on participants and improper evaluation of applicants, cases were initiated and binding instructions were issued. In addition, administrative offence reports were drawn up against the responsible persons and submitted to the judicial authorities.
📍Syrdarya Region:
Competitive (tender) procedures conducted by the Syrdarya Thermal Power Plant Branch of JSC “Thermal Power Networks” were reviewed.
Violations of the requirements of Article 29 of the Law “On Competition”, as well as Articles 42, 46 and 61 of the Law “On Public Procurement”, were identified in a procurement procedure with a total value of UZS 22.5 billion.
The territorial administration initiated a case pursuant to the Regulation approved by Resolution No. 225 of the Cabinet of Ministers dated 12 October 2005 and issued a binding instruction.
📍Fergana Region:
Compliance with competition legislation in public procurement procedures was reviewed at the Margilan City Improvement Department. It was established that violations of the requirements of the Law “On Competition” had occurred in best-offer selection procedures conducted during 2025 and January–April 2026, with a total initial value of approximately UZS 1.2 billion.
In addition, a review conducted at the Buvayda District State Road Maintenance Institution established that the contracting authority had failed to comply with legislative requirements in best-offer selection procedures conducted during 2025 and January–April 2026, with a total initial value of UZS 275 million.
With respect to both cases, the special commission of the territorial administration initiated proceedings for violations of the requirements of Article 29 of the Law “On Competition” and issued binding instructions. Administrative proceedings were also initiated against the officials concerned under Part 5 of Article 178 of the Code of Administrative Responsibility, and the cases were submitted to the court for consideration.
The Competition Promotion and Consumer Protection Committee of the Republic of Uzbekistan will continue its systematic monitoring of the public procurement sector and the implementation of appropriate measures in response to identified violations of legislation.
