The Antimonopoly Committee investigated the situation with unfair competition in the book publishing market based on the application of “YANGI ASR AVLODI” LLC. Investigation identified a number of problems in market. One of the issues is related to the authors, the other – to publishers. In one case, the author of a work or the translator who translated it concluded an agreement with the publishing house »YANGI ASR AVLODI» LLC for the publication of this work. Under the terms of the agreement, the parties undertook not to transfer the work or part of it to other organizations for publication without the prior written consent of the parties, otherwise compensation for losses was provided, including lost profits in accordance with Article 1070 of the Civil Code of the Republic of Uzbekistan.
However, the applicant discovered that some of the works he published were also published by other publishers and complained of copyright infringement, arguing that they did not have the right to do so. Author later signed an agreement with other publishing houses for the publication of these works. However, in this case, as stated in the contract, the author did not even notify him, apart from obtaining the written consent of “YANGI ASR AVLODI” LLC. The investigation revealed that another publishing house reprinted the book, reproducing the cover design of the previously published book by “YANGI ASR AVLODI” LLC. And in this case, the author agreed to the publication of the work, but this consent does not mean that he can duplicate the appearance of the book cover, since the design is the intellectual property of the publisher and its use requires the appropriate consent of the owner. This fact took place during the publication of Kamil Sindarov’s book “The Secret of the Temurid Library”. Some works published by “YANGI ASR AVLODI” LLC were also published by unknown publishers without indicating their name or under the name of “YANGI ASR AVLODI” LLC (without his consent) and sold to readers. In addition to the name of the company, in the books published by “YANGI ASR AVLODI” LLC a QR code was placed in order to provide the reader with complete information about the publishing house and its activities. An example is the fact that counterfeit versions of the works of Khudoiberdi Tukhtaboev “The Kingdom of Rabbits”, “Black Eyes” are called “YANGI ASR AVLODI” LLC, but there is no QR code in the published materials. Representatives of the publishing houses participating in the study noted that unidentified persons printed and sold books on low-quality paper, including under the names of well-known publishers, as a result of which the publishing house named in the book had to bear responsibility before criticizing readers.
The publishing house that violated the law in the antimonopoly environment was instructed about correcting the situation. It should be noted that such dishonesty was revealed as a result of studying the appeal of one publisher, but such cases could take place in other publications. Dear authors, do not forget about your contractual obligations when working with a publisher to publish a work. Dear publishers competing in the world of books, let your competition be fair! Because the book is spirituality. In spirituality, honesty is more important than competition.
