The Committee examined a complaint concerning the compliance of the sunflower oil product “Oila Tanlovi” (refined deodorized sunflower oil), purchased from the “UZUM MARKET” LLC marketplace, with the requirements of technical regulation documents.
The review revealed that the product manufactured by “BO‘STON FOOD COMPANY” LLC on the order of “UZUM MARKET” LLC indicated a shelf life of 12 months on its packaging, whereas at that time the applicable GOST 1129-2013 standard allowed only a 6-month shelf life. This was deemed unjustified. Additionally, the packaging did not indicate the valid (UzTR No. 724) technical regulation but instead displayed an outdated one.
On this basis, the Special Commission of the Committee initiated a case in accordance with the established procedure. Upon reviewing the case, it was determined that “UZUM MARKET” LLC and “BO‘STON FOOD COMPANY” LLC had violated Article 6 of the Law “On Protection of Consumer Rights.” To remedy the violations, the enterprises were instructed as follows:

Within one month, to withdraw from consumers nearly 145,000 units of “Oila Tanlovi” oil products labeled with a 12-month shelf life (by refunding the purchase price or replacing them with equivalent quality products); or

To return to consumers, and if impossible to identify consumers, to the state budget, the total amount of more than 1.6 billion soums received as a result of the violation of consumer rights.
Subsequently, the above entities filed claims in several court instances, seeking to invalidate the decision and instructions of the Special Commission of the Committee. However, by the relevant judicial rulings, the claims were not satisfied, and the decision and instructions of the Committee were upheld.
