The Antimonopoly Committee received an appeal from the “PERFECT CANDY” LLC regarding the business activities of “Usta Xasan Qandolatchi” LLC.
While examining the case, it turned out that “PERFECT CANDY” LLC is a manufacturer of sweets and a holder of the ZEBRA trademark. It also turned out that the label ZERDA sweets is similar to the degree of confusion with the label ZEBRA. It was also confirmed that both manufacturers have the same consumer circle, are competitors and participate in the same product market.
Eventually it was noted that the presence of similar candy labels in the civil circulation may mislead the consumer.
Thus, the case was considered at the meeting of the Special Commission of the Antimonopoly Committee and based on its results the Commission has decided to recognize the sale of ZERDA sweets as the fact of unfair competition.
The offender was issued an order to stop the production and sale of ZERDA sweets with an appearance similar to the degree of confusion with the ZEBRA trademark, as well as to destroy within a month all the remaining (in warehouses) labels, packages, boxes and other packaging materials of sweets with the word designation “ZERDA”.
