The Antimonopoly Committee has considered the appeal of the company “Suntronix PTE LTD” (Singapore) on unjustified disqualification from the competitive bidding held by the JSCB “Halk Bank” for the provision of consulting services.
The study revealed that the proposal of the company “Suntronix PTE LTD” was withdrawn from consideration without evaluation due to insufficient work experience and non-compliance with the requirements of the tender documentation. At the same time, according to the tender documentation, the proposals are evaluated by means of points, where the direct removal of the participant from the auction is not provided.
(in accordance with the criteria of technical assessment, if there is at least 3 projects of experience in similar projects, the participant is awarded 1 point, in the absence of the required experience 0 points).
“Suntronix PTE LTD” in its technical proposal provided 4 projects that were implemented in the banks of the Republic of Uzbekistan.
Also, the tender documentation provides for the award of points to the performer’s personnel. For example, if there are at least 2 experts, a master’s degree from a university, work experience in financial institutions for at least 10 years, experience in the transformation of commercial banks with a state share of at least 2 projects, 1 point is awarded for each point, in case of discrepancy 0 point.
The offer of the company “Suntronix PTE LTD” includes 5 experts, of which 2 experts meet the requirements of the tender documentation, which makes it possible to fully participate in the auction.
However, according to the approved appraisal report, the experts of “Suntronix PTE LTD” do not meet the requirements of the tender documentation for multiple reasons that are not provided for in the tender documentation.
At the same time, the price offer of TA Consult (Great Britain), which was announced as the winner after the auction, amounted to USD 284,000, including a discount of USD 227,200.
At the same time, the condition for granting a discount to TA Consult is 70 percent prepayment of the total amount of the contract, while under the terms of the contract (the contract is an annex to the tender documentation), the prepayment is 50% of the total cost of the contract.
Based on the above facts, a case was initiated on violation of the requirements of Article 14 of the Law “On Competition” in terms of violation of the procedure for holding tenders and unjustified disqualification of tenders.
Based on the results of the consideration of the case, the Committee issued an order to eliminate the above violations.
However, JSCB “Halk Bank” applied to the court to declare the decision and order of the Antimonopoly Committee invalid. The court refused to satisfy the claims of JSCB “Halk Bank”.
