The Antimonopoly Committee received an appeal from JV “BUXOROGIPS” with a request to help protect its intellectual property in the form of trademarks “ROTBAND”, “KNAUF” and “ROTBAND” from unscrupulous manufacturers of dry building mixtures under the trademark “RODBIN” produced by LLC “Xurram Zilol” (Zangiata region) and “ROTBIN” of the family enterprise “Qurilish Mollari Markazi” (Tashkent region), which imitate the trade mark of the JV BUXOROGIPS.
The original trademarks “ROTBAND”, “KNAUF” and “ROTBAND” are registered by JV “BUXOROGIPS” in the Intellectual Property Agency and have a certificate No. MGU 26048 dated 09.11.2012. At the same time, Xurram Zilol LLC and Qurilish Mollari Markazi JV did not submit applications to the Agency for certification of trademarks.
According to the expert’s conclusion, the name “RODBIN” used by “Xurram Zilol” LLC and “ROTBIN” from JV “Qurilish Mollari Markazi” phonetically mislead the consumer of goods under the trademark “KNAUF ROTBAND” owned by JV “BUXOROGIPS”.
LLC “Xurram Zilol” in 2019-2020 produced 25 thousand kg of products in bags of 25 kg each. As of 20.10.2020, 11.2 thousand kg of products remained in the warehouse.
JV “Qurilish Mollari Markazi” began its activities on July 7, 2020 and by October 8, 2020 under the trade name “ROTBIN”, 54 thousand. kg of dry building mixtures. Today, the remainder of the products in the warehouse of the enterprise is 14 thousand kg. At the same time, the manufacturer does not have any documents confirming the right to use this trademark.
During the consideration of the case, it was revealed that Xurram Zilol LLC and Qurilish Mollari Markazi JV violated Article 13 of the Competition Law, as a result of which, a special commission of the Tashkent regional department of the Committee opened a case against these manufacturers and issued an order violations and termination henceforth.
