In accordance with clause 9 of the Resolution of the President of the Republic of Uzbekistan dated 04.04. PP-4664 The Interdepartmental Tariff Commission under the Cabinet of Ministers from May 1, 2020 set tariffs for the provision of services for the storage of oil products and hydrocarbons in free tanks of oil depots to business entities involved in the import of oil products and hydrocarbons.
From May 1, 2020, the Bukhara Oil Refinery, as an additional condition to the contract for the sale of diesel fuel and gasoline through exchange trading, OJSC UzEX provided a separate payment for the shipment of products from the tank farm. In accordance with this, LLC “Bukhoro Neftbazasi” began to charge consumers an additional fee for transportation costs.
In order to revise the terms of the agreement on levying additional payments from consumers for loading and unloading of oil products, the Bukhara Territorial Administration of the Antimonopoly Committee requested information through an official letter from Bukhoro Neftbazasi LLC for all information and justifications for these actions.
Bukhoro Neftbazasi LLC, it provided the information that consumers were not charged for storing petroleum products, on the contrary, delivery costs were paid by concluding separate agreements with consumers.
To find confirmation of this information, the Bukhara territorial administration of the AMC sent inquiries to the relevant organizations, since completely opposite information was voiced in the appeals of entrepreneurs of the Bukhara region. Based on the results of the study, the Office found out that LLC Bukhoro Neftbazasi in total received an unjustified income of 62.1 million soums from six entrepreneurs – consumers of oil products,.
In accordance with Article 23 of the Law “On Competition”, the Special Commission of the Bukhara Territorial Administration opened a case against LLC “Bukhoro Neftbazasi” and issued an order to eliminate the violation.
As a result of the case, 62.1 million soums of unjustified income were recalculated in favor of consumers.
