In order to fulfill the Decree of the President of the Republic of Uzbekistan dated July 6, 2020 No. – 6019 “On additional measures to further develop the competitive environment and reduce state participation in the economy”, as well as to prevent violations of antimonopoly legislation, on March 2, 2021, the Cabinet of Ministers adopted Resolution No. 114 “On measures to introduce an antimonopoly compliance system”.
The Appendix of the Resolution approves the Charter “On the introduction and enforcement of antimonopoly compliance in public administration, local executive bodies and enterprises” and the corresponding “Road Map“.
The aforementioned Regulation applies:
– from January 1, 2021 – in a pilot mode, government bodies, local executive bodies and state-owned enterprises included in the list approved by Presidential Decree No. 6019 of July 6, 2020;
– From January 1, 2022 – natural monopolies, business entities that occupy a dominant position in the commodity or financial market, as well as corporate clients, whose average annual revenue from the sale of goods over the past 3 years exceeds 30 billion soums.
Also, the organization of the antitrust compliance system and the assessment of its effectiveness:
– in public administration – the head;
– in local authorities – khokim;
– in business entities – by the executive body or the supervisory board.
Expected Result:
Creation of an effective system for preventing the risk of violating the requirements of antimonopoly legislation, introducing corporate business standards;
Formation of a new model for protecting competition based on the business reputation of the market entity and mechanisms for preventing actions (inaction) that undermine competition;
Prevention of risks of violation of requirements of antimonopoly legislation and elimination of violations of the law and their prevention in the subsequent period;
Reducing the number of actions (inaction) that are contrary to competition law.
