The territorial office of the Competition Promotion and Consumer Protection Committee of the Republic of Uzbekistan in the Andijan region received an appeal from a citizen.
In this appeal, the following was stated, in 2023, the citizen paid Erkin Xous LLC initial payment in the amount of 28 500 000 UZS, on the basis of the contract of sale of the house. Then, the citizen applied to the LLC for the return of initial payment due to the fact that the house was not completed on time. However, the citizen failed to receive this amount, and therefore appealed to the Competition Committee for practical help in resolving his situation.
Article 19 of the Law of the Republic of Uzbekistan “On Consumer Rights Protection” states that if the contractor does not begin to execute the contract on time or it turns out that the contract will not be executed within the specified period, it was explained that the owner has the right to withdraw from the contract for the performance of works and services and to demand compensation for the damage caused.
As a result of the work carried out, Erkin Xous LLC returned 28 500 000 UZS of the initial payment for the purchase of housing to the citizen.
