Ularda asosan qurilish tashkilotlari bilan tuzilgan shartnoma shartlarining buzilishi \u2014 yangi uy-joylarni o\u2018z vaqtida topshirmaslik, shartnomada belgilangan talablarni bajarmaslik, reklama va e\u2019lonlarda ko\u2018rsatilgan loyihalarga amal qilmaslik kabi holatlar bayon etilgan.<br \/>\nShuningdek, murojaatlarni o\u2018rganish jarayonida ayrim qurilish korxonalari shartnomalarga qonunchilikka zid bandlar kiritayotgani ham aniqlandi. Xususan, shartnoma shartlarida \u201cagar iste\u2019molchi o\u2018z tashabbusi bilan shartnomani bekor qilsa, qurilish tashkiloti iste\u2019molchi tomonidan to\u2018langan mablag\u2018ning yoki shartnoma qiymatining 10 foizi miqdoridagi summani jarima sifatida ushlab qolish huquqiga ega\u201d deb belgilangan holatlar ko\u2018plab kuzatilmoqda.<br \/>\nAmalda esa bunday talablar qonun normalariga zid hisoblanadi.<br \/>\nFuqarolik kodeksining<br \/>\n385-moddasida shartnoma bekor qilinganda faqat ikkinchi tarafga aniq zarar yetkazilgan taqdirdagina uni qoplash mumkinligi belgilangan.<br \/>\n14-moddada \u201czarar\u201d tushunchasi haqiqiy zarar va boy berilgan foyda sifatida ko\u2018rsatilgan bo\u2018lib, amalda iste\u2019molchi shartnomani bekor qilganda qurilish tashkilotiga zarar yetmaydi. Chunki ko\u2018p qavatli uylar tipik loyiha asosida quriladi va qurilish tashkilotlari bunday obyektlarni osonlikcha boshqa xaridorga sotishi mumkin. Bundan tashqari, uylarga talab yuqori va narxlar yildan yilga ortib borayotgani qurilish tashkilotlari ko\u2018p hollarda foyda ko\u2018rishini ta\u2019minlaydi.<br \/>\nKodeksining 260-moddasida ham neustoyka (jarima, penya) qarzdor o\u2018z majburiyatini bajarmagan yoki lozim darajada bajarmagan hollardagina qo\u2018llanishi mumkinligi belgilangan. Aksariyat hollarda esa iste\u2019molchi o\u2018z to\u2018lov majburiyatlarini o\u2018z vaqtida bajarib bo\u2018ladi, qurilish tashkiloti esa uyni topshirmagunga qadar qarzdor maqomida qoladi.<br \/>\nShu bois, iste\u2019molchining tashabbusi bilan shartnoma bekor qilinganda undan jarima undirish qonunga zid hisoblanadi.<br \/>\nBu holat \u201cIste\u2019molchilar huquqlarini himoya qilish to\u2018g\u2018risida\u201dgi Qonunning<br \/>\n21-moddasiga ko\u2018ra, iste\u2019molchi huquqlarini cheklovchi va qonunga zid bo\u2018lgan shartlar haqiqiy emas deb hisoblanadi,<br \/>\n23-moddasida esa iste\u2019molchining ustuvor huquqi kafolatlangan.<br \/>\nShuningdek, \u201cTadbirkorlik faoliyati erkinligining kafolatlari to\u2018g\u2018risida\u201dgi Qonunning 9-moddasida tadbirkorlik subyektlari raqobat va iste\u2019molchilar huquqlari to\u2018g\u2018risidagi qonunchilikka amal qilishi shartligi belgilangan.<br \/>\nYuqoridagi holatlardan kelib chiqib Raqobat qo\u2018mitasi ogohlantiradi.<br \/>\nHURMATLI FUQAROLAR:<br \/>\n&#x1f4c3; Yangi qurilayotgan uy-joydan xonadon xarid qilishda shartnoma tuzishdan oldin uning barcha shartlari bilan atroflicha tanishib chiqishingiz juda muhim.
