{"id":34698,"date":"2023-08-14T17:08:51","date_gmt":"2023-08-14T12:08:51","guid":{"rendered":"https:\/\/raqobat.gov.uz\/?p=34698"},"modified":"2023-08-14T17:08:51","modified_gmt":"2023-08-14T12:08:51","slug":"raqobat-togrisidagi-qonun-taklif-va-yechimlar","status":"publish","type":"post","link":"https:\/\/raqobat.gov.uz\/uz\/raqobat-togrisidagi-qonun-taklif-va-yechimlar\/","title":{"rendered":"Raqobat to\u2018g\u2018risidagi qonun: taklif va yechimlar"},"content":{"rendered":"<p><strong>Sherzod SHODMONQULOV, <\/strong><\/p>\n<p><strong>Raqobatni rivojlantirish va iste\u2019molchilar <\/strong><\/p>\n<p><strong>huquqlarini himoya qilish qo\u2018mitasi bo\u2018lim boshlig\u2018i. <\/strong><\/p>\n<p><strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Birinchidan, \u201cRaqobat to\u2018g\u2018risi\u00adda\u201dgi Qonun o\u2018zida ilgari mavjud bo\u2018lmagan bir qator normalar\u00adni o\u2018zida aks ettirgani bilan o\u2018ziga xos hujjatdir. <\/strong><\/p>\n<p>U amaldagi \u201cRaqobat to\u2018g\u2018risida\u201dgi va \u201cTabiiy monopoliyalar to\u2018g\u2018risida\u201dgi Qo\u00adnunlarining birlashtirilishi natijasida yaratilgan bo\u2018lib, asosiy maqsadi raqobatga qarshi harakatlarning kamayishi, iqtiso\u00addiy faoliyat erkinligi va iqtisodiyotda davlat ishtirokini qisqartirishga qara\u00adtilgan.<\/p>\n<p>Ikkinchidan, amaldagi qonunchilikda raqamli platformalar operatorlarining raqobatni cheklovchi va iste\u2019molchilar manfaatlarini kamsituvchi harakatlari\u00adga ta\u2019qiqlar va davlatning tadbirkorlik faoliyatidagi ishtirokiga talablar bel\u00adgilanmagan. Yangi Qonunda bir qator tu\u00adshunchalar kiritilgan. Amaldagi Qonunda raqobat sohasidagi asosiy prinsiplar ko\u2018rsatilmagan. Endi esa insofli raqobat, qonuniylik, iste\u2019molchilar huquqlari va qonuniy manfaatlari ustuvorligi, shaffoflik, tenglik prinsiplar alohida belgilangan. Ilgari qonunchilikda yori\u00adtilmagan iste\u2019molchilar huquqlarini inobatga olgan holda raqobatni himoya qi\u00adlish, raqobatga qarshi harakatlarni ol\u00addini olish va to\u2018xtatish, raqobat muhitini rivojlantirish, tovar va moliya bozorla\u00adrining samarali faoliyat ko\u2018rsatishi uchun shart-sharoitlar yaratish, tovar va moliya bozorlari ishtirokchilarining iqtisodiy faoliyati erkinligini hamda tovarlar\u00adning erkin harakatlanishini ta\u2019minlash, davlatning iqtisodiyotdagi ishtirokini qisqartirish, raqobat muhitini yaxshilash va rivojlantirish uchun respublika ijro etuvchi hokimiyat organlarining javobgar\u00adligini oshirish kabi monopoliyaga qarshi davlat siyosatining asosiy yo\u2018nalishlari o\u2018z aksini topgan.<\/p>\n<p>Qonunchilikda mavjud bo\u2018lmagan yana bir jihat \u2014 Raqobatni rivojlantirish va iste\u2019molchilar huquqlarini himoya qilish qo\u2018mitasi o\u2018z faoliyatida bevosita O\u2018zbeki\u00adston Respublikasi Prezidentiga va Oliy Majlis Senatiga hisobdorligi, o\u2018z fao\u00adliyatini davlat organlari, boshqa tashki\u00adlotlar va mansabdor shaxslardan mustaqil ravishda amalga oshirishi yangi qonunda alohida o\u2018rin olgan. Amaldagi qonunchilik\u00addan farqli o\u2018laroq, hozir vakolatli davlat organi normativ-huquqiy hujjatlar va ular loyihalarining raqobatga ta\u2019siri\u00adni baholashi nazarda tutilgan. Vakolatli davlat organi qonunlar, O\u2018zbekiston Respublikasi Prezidenti farmonlari va qa\u00adrorlari, Vazirlar Mahkamasi qarorlari yuzasidan Prezident Administratsiyasi hamda Vazirlar Mahkamasiga o\u2018rnatilgan tartibda takliflar kiritadi.<\/p>\n<p>Qonunbuzilishlarini oldini olishga qaratilgan huquqiy institut bugungi kun\u00adda qonunchilikda nazarda tutilmagan. Yangi qonunning alohida moddasi monopoliyaga qarshi komplayensni majburiy tartibda joriy etish asoslariga bag\u2018ishlangan.<\/p>\n<p>Ma\u2019lumki, bir xo\u2018jalik yurituvchi sub\u2019\u00adektning bozordagi ulushi holatiga qarab bozorga hal qiluvchi ta\u2019sir o\u2018tkazish imko\u00adniyatini beradigan holat ustun mavqe hi\u00adsoblanadi. Amaldagi qonunga ko\u2018ra, tovar bozorida qaysi xo\u2018jalik yurituvchi suby\u00adekt yoki shaxslar guruhi tovarining ulushi ellik va undan ortiq foizni tashkil etsa hamda kamida bir yil davomida o\u2018ttiz besh foizdan ellik foizgacha hajmda bo\u2018lsa, shu xo\u2018jalik yurituvchi subyektning yoki shaxslar guruhining mavqei ustun mavqe deb e\u2019\u00adtirof etiladi. Endilikda ustun mavqeni aniqlashning yangi mezonlari qonunda o\u2018z aksini topgan, ya\u2019ni bozorda raqobatchi\u00adlari mavjud bo\u2018lmagan, bozordagi ulushi 40 foizni (hozirgi 35 foiz o\u2018rniga) va undan ortiqni tashkil etgan, muayyan tovarlarni ishlab chiqarish yoki realizatsiya qilish bo\u2018yicha mutlaq va eksklyuziv huquqi berilgan xo\u2018jalik yurituvchi subyekt ustun mavqega ega sanaladi. Bunda tabiiy monopoliyalar ham ustun mavqega ega subyektlar qatoriga qo\u2018shilmoqda. Shuningdek, oxirgi kalendar yilida tovarlarni sotishdan tushgan tushu\u00admi bazaviy hisoblash miqdorining o\u2018ttiz ming baravaridan (9,9 mlrd so\u2018m) oshmaydi\u00adgan korxonalarga nisbatan ustun mavqeni e\u2019tirof etish tatbiq etilmaydi, tabiiy monopoliya subyektlari, mahsulotlarining narxlari davlat tomonidan tartibga soli\u00adnadigan shaxslar bundan mustasno.<\/p>\n<p>Qonunning yangilik jihatlaridan yana biri unda ustun muzokara kuchi institu\u00adtining ifodalanayotganidir. Bu haqdagi moddada, ustun mavqega ega bo\u2018lmagan, biroq korxona tomonidan bitim shartlarini, tovarlar realizatsiya qilinadigan hududni va narxni belgilashga bir tomonlama ta\u2019\u00adsir ko\u2018rsatish imkoniyatining mavjudligi ustun muzokara kuchi deya e\u2019tirof etil\u00adgan. Mazkur norma hozirda ayrim savdo tarmoqlarida muayyan \u201cyuqori muzokara ustunligi\u201d borligi, ta\u2019minotchilar bilan shartnoma tuzishda, ularni kamsituvchi va foydali bo\u2018lmagan shartlarni kiritish ho\u00adlatlari mavjudligi tufayli qonunda aks ettirilgan.<\/p>\n<p>Bundan tashqari, raqobatga qarshi keli\u00adshuvlar va muvofiqlashtirilgan harakat\u00adlar uchun ma\u2019muriy va moliyaviy javobgar\u00adlikdan ozod qilish tartibi kiritilmoqda. Ya\u2019ni, raqobatga qarshi kelishuv yoki muvo\u00adfiqlashtirilgan harakatni sodir etgan korxona yoki jismoniy shaxs bu haqda vako\u00adlatli davlat organini birinchi bo\u2018lib ix\u00adtiyoriy ravishda xabardor qilsa, u javob\u00adgarlikdan ozod etiladi.<\/p>\n<p>Tahlillarga qaraganda, 2021-yilda dav\u00adlat tomonidan 58 mingta xo\u2018jalik yurituv\u00adchi subyektga 44 trln 796 mlrd so\u2018mlik va 2022-yilda jami 111,1 mingta xo\u2018jalik yurituvchi subyektga 72 trln 964 mlrd so\u2018mlik imtiyozlar berilgan. Chunki, qonun\u00adchilikda davlat yordamini taqdim etishga nisbatan talablar mavjud emas. Yangi Qo\u00adnunda bunday yordamni taqdim etish shakl\u00adlari va unga nisbatan talablar belgilan\u00adgan. Davlat yordamini berishni nazarda tutuvchi normativ-huquqiy hujjatlar loyihalari raqobat muhitiga ularning ta\u2019sirini baholashdan o\u2018tkazish uchun mo\u00adnopoliyaga qarshi organga majburiy tar\u00adtibda kiritish zarurligi ko\u2018rsatilgan.<\/p>\n<p>Davlatning tadbirkorlik faoliyatida ishtirok etishiga nisbatan ham talablar qo\u2018yilgan. Unga ko\u2018ra, davlatning tadbir\u00adkorlik faoliyatidagi ishtiroki korxona tashkil etish, uning ustav fondida ishti\u00adrok etish va davlat-xususiy sheriklik orqali amalga oshiriladi. Davlat ishti\u00adrokidagi korxonalarni tashkil etishga vakolatli davlat organining oldindan roziligi olinganidan keyin yo\u2018l qo\u2018yila\u00addi. Shuningdek, davlatning tadbirkorlik faoliyatida ishtirok etishi taqiqlangan holatlar ham qayd etilgan.<\/p>\n<p>Bugungi kunda iqtisodiy konsentratsiya (korxonalarni qo\u2018shib olish yoki qo\u2018shib yuborish)ga rozilik olish talab qilinadi\u00adgan bitimlar bo\u2018yicha korxonalar aktivla\u00adriga bo\u2018lgan mezon pastligi sababli kichik va o\u2018rta biznes subyektlariga nisbatan ma\u2019muriy yuk yuqoriligicha qolmoqda. Shu\u00adning uchun kichik va o\u2018rta biznes subyektla\u00adriga nisbatan ma\u2019muriy yukni qisqarti\u00adrish maqsadida iqtisodiy konsentratsiya (korxonalarni qo\u2018shib olish yoki qo\u2018shib yuborish)ga rozilik olish talab qilina\u00addigan bitimlar bo\u2018yicha korxonalar aktiv\u00adlari qiymatiga va tovarlarni realizatsiya qilishdan olgan tushumiga talab 5 baravar\u00adga oshirilishi normasi qonunda alohida o\u2018rin topgan. Endilikda bitim tarafi hisoblangan korxonalarning jami aktiv\u00adlari qiymati yoki oxirgi kalendar yilda tovarlarni realizatsiya qilishdan olingan jami tushumi 165 mlrd (amalda 33 mlrd) so\u2018mdan (alohida-alohida hisoblanganda esa, 82 mlrd 500 mln so\u2018m) kam bo\u2018lgan\u00adda korxonalarni qo\u2018shib olish yoki qo\u2018shib yuborishda rozilik olish talab etilmaydi.<\/p>\n<p>Ta\u2019kidlash joizki, hozirda monopoliyaga qarshi organning raqobatga zid harakat\u00adlarni aniqlash va bartaraf etish bo\u2018yicha vakolatlari yetarli emas. Mazkur holat inobatga olinib, Qonun asosida monopo\u00adliyaga qarshi organga qo\u2018shimcha vakolatlar berilgan. Asosiy oziq-ovqat mahsulotlari narxlarining keskin tebranishi davrida zarur choralarni ko\u2018rish, davlat yordami sa\u00admaradorligi ustidan nazorat qilish shular jumlasidandir.<\/p>\n<p>Amaldagi qonunda moliyaviy jarimalar nazarda tutilmagan. Faqat Ma\u2019muriy ja\u00advobgarlik to\u2018g\u2018risidagi Kodeksda ma\u2019muriy jarimalar miqdori jismoniy shaxslar uchun BHMning 1-3 baravari, mansabdor shaxslar uchun esa BHMning 5-10 baravari miqdorida o\u2018rnatilgan. Endi esa raqobat to\u2018g\u2018risidagi qonun hujjatlarini buzgan\u00adlik uchun moliyaviy jarimalar belgilanib, ma\u2019muriy javobgarlik kuchaytirilgan. Raqobatni cheklovchi kelishuvlar (kartel), iqtisodiy faoliyatni muvofiqlashtirish, ustun mavqe va ustun muzokara kuchini suiiste\u2019mol qilish, strategik ahamiyatga ega bo\u2018lgan mahsulotlar narxlarini asossiz ra\u00advishda oshirganlik uchun tovar aylanmasi\u00adning 5 foizi, savdolarga doir talablarni buzganda savdo predmeti boshlang\u2018ich qiy\u00admatining 3 foizi, insofsiz raqobatni sodir etishda tovar aylanmasining 2 foizi, iqtisodiy konsentratsiyada raqobat qonunchiligi buzilganda BHMning 1000 baravari miqdorida moliyaviy jarima qo\u2018llaniladi. Ma\u2019muriy jarimalar miq\u00addori jismoniy shaxslar uchun BHMning 3-10 baravarigacha, mansabdor shaxslar uchun esa BHMning 30-50 baravarigacha miqdorni tashkil etadi. Moliyaviy jari\u00adma sud tartibida qo\u2018llaniladi (huquqbuzar aybini tan olib, jarimani ixtiyoriy ra\u00advishda to\u2018lagan holatlar bundan mustasno).<\/p>\n<p>Ma\u2019lumki, \u201cRaqobat to\u2018g\u2018risida\u201dgi yangi Qonun joriy yilning 4-oktabridan kuchga kiradi. Ungacha Qo\u2018mita tomonidan ushbu Qonunning samarali ishlashini ta\u2019min\u00adlash mexanizmlari va tartiblarini ishlab chiqish choralari ko\u2018rilmoqda. Amaldagi bir qator normativ-huquqiy hujjatlarga o\u2018zgartirishlar kiritilmoqda va loyiha\u00adlari tayyorlanmoqda. Misol uchun, raqobat to\u2018g\u2018risidagi qonunchilik buzilishi alo\u00admatlari bo\u2018yicha ish qo\u2018zg\u2018atish va tegishli choralarni ko\u2018rish tartibiga o\u2018zgartirishlar kiritish ustida ish olib borilmoqda. Bundan tashqari, raqamli platformalarda ustun mavqe holatining e\u2019tirof etilishi va ushbu ustun mavqening suiiste\u2019mol qi\u00adlinishi holatini aniqlash tartibi Jahon banki va Osiyo taraqqiyot banki ekspert\u00adlari bilan hamkorlikda tayyorlanmoqda.
