width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\"><\/span><\/iframe><\/p>\n<h3><strong>Raqobatni rivojlantirish va iste\u2019molchilar huquqlarini himoya qilish qo\u2018mitasi tomonidan 2023-yilning 1-yarim yilligida amalga oshirilgan ishlar<\/strong><\/h3>\n<p>&nbsp;<\/p>\n<p><strong>Normativ-huquqiy bazani takomillashtirish sohasida amalga oshirilgan ishlar<\/strong><\/p>\n<p>Raqobatni rivojlantirish va iste\u2019molchilar huquqlarini himoya qilish qo\u2018mitasi tomonidan 2023 yilning yanvar-iyun oylari davomida\u00a0<strong>10<\/strong>\u00a0<strong>ta<\/strong>\u00a0normativ-huquqiy hujjat loyihalari ishlab chiqilgan. Shundan,\u00a0<strong>2<\/strong>\u00a0<strong>ta<\/strong>\u00a0Prezident qarori loyihasi,\u00a0<strong>2<\/strong>\u00a0<strong>ta<\/strong>\u00a0Vazirlar Mahkamasi qarori,\u00a0<strong>5<\/strong>\u00a0<strong>ta<\/strong>\u00a0Qo\u2018mita qaror loyihasi hamda\u00a0<strong>1<\/strong>\u00a0<strong>ta<\/strong>\u00a0qo\u2018shma-qaror loyihasi tayyorlangan.<\/p>\n<p><strong>Qonun hujjatlari va davlat organlari qarorlarining raqobat muhitiga ta\u2019sirini baholash<\/strong><\/p>\n<p>Davlat va xo\u2018jalik boshqaruvi organlari hamda mahalliy davlat hokimiyati organlari tomonidan project.gov.uz portali orqali Qo\u2018mita va uning hududiy organlariga kelib tushgan\u00a0<strong>1242<\/strong>\u00a0<strong>ta<\/strong>\u00a0normativ-huquqiy hujjatlar loyihalarining (ex-ante) raqobat muhitiga ta\u2019siri yuzasidan xulosalar tayyorlandi, shundan\u00a0<strong>104<\/strong>\u00a0<strong>ta<\/strong>\u00a0(<strong>8,4 %<\/strong>) qonunchilik talablariga zid normalar mavjudligi aniqlangan.<\/p>\n<p>Shuningdek, Qo\u2018mita Markaziy apparatiga kelib tushgan\u00a0<strong>171<\/strong>\u00a0<strong>ta<\/strong>\u00a0normativ-huquqiy hujjatlar loyihalariga xulosalar tayyorlandi, shundan\u00a0<strong>96<\/strong>\u00a0<strong>ta\u00a0<\/strong>(<strong>56,7 %<\/strong>) qonunchilik talablariga zid normalar ekanligi aniqlandi.<\/p>\n<p>Respublika bo\u2018yicha mahalliy davlat hokimiyati organlari va davlat boshqaruv organlarining qabul qilgan normativ-huquqiy va boshqa hujjatlari raqobat to\u2018g\u2018risidagi qonunchilik normalariga muvofiqligi yuzasidan xatlovdan o\u2018tkazilganda\u00a0<strong>291<\/strong>\u00a0<strong>ta<\/strong>\u00a0qonunbuzilish holatlari aniqlandi va bu holat bo\u2018yicha tegishli ishlar qo\u2018zg\u2018atilgan va ishlar yakuni yuzasidan qaror va ko\u2018rsatmalar yuborilib,\u00a0<strong>76<\/strong>\u00a0<strong>ta<\/strong>\u00a0hujjatlar bekor qilingan.<\/p>\n<p><strong>Davlat xaridlarida raqobatni ta\u2019minlash<\/strong><\/p>\n<p>Qo\u2018mita tomonidan joriy yilning 1-yarim yilligida davlat buyurtmachilari tomonidan o\u2018tkazilgan\u00a0<strong>18\u00a0131<\/strong>\u00a0<strong>ta<\/strong>\u00a0tanlov (tender) savdolarida tahlil ishlari olib borildi. Tahlil natijasida buyurtmachilar tomonidan\u00a0<strong>6\u00a0838\u00a0ta<\/strong>\u00a0savdolar jarayonida\u00a0<strong>10\u00a0632\u00a0ta<\/strong>\u00a0raqobatga zid harakatlar aniqlangan.<\/p>\n<p>Xususan:<\/p>\n<p>Davlat buyurtmachilari tomonidan joriy yilning iyul oyiga qadar davlat xaridlari elektron tizimlari (xarid.uzex.uz, xt-xarid.uz, tender.mc.uz) orqali amalga oshirilgan savdolarning\u00a0<strong>10\u00a0433<\/strong>\u00a0<strong>ta<\/strong>si qo\u2018mita tomonidan tahlil qilindi. O\u2018rganilgan tanlov (tender) savdolarini tahlili natijasida buyurtmachilar tomonidan\u00a0<strong>1\u00a0340\u00a0ta<\/strong>\u00a0savdolar jarayonida\u00a0<strong>1\u00a0375\u00a0ta<\/strong>\u00a0raqobatga zid holatlar aniqlangan.<\/p>\n<p>Mazkur qonunbuzilishlar savdolar o\u2018tkazishning qonun hujjatlarida belgilangan tartibini buzish \u00a0ya\u2019ni\u00a0<em>baholash mezonlarini belgilamaslik, affillangalik to\u2018g\u2018risidagi ma\u2019lumotlarni oshkor etmaslik, noto\u2018g\u2018ri baholash, murojaatchilarga tushuntirish bermaslik, savdo natijalarini oshkor etmaslik, shartnoma tuzishni rad etish, affillanganlikni aniqlamaslik, manfaatlar to\u2018qnashuvini oldini olmaslik, shuningdek,\u00a0<\/em>til biriktirish orqali kelishib olingan, muvofiqlashtirilgan harakatlar\u00a0<em>(ishtirokchilarni asossiz ravishda chetlashtirish, ayrim ishtirokchilarga imtiyozli shart-sharoitlar yaratib berish, haddan ziyod yuqori texnik talablar belgilash, yetkazib berish muddatlarini qisqa belgilash, lotlar tarkibiga savdolarning predmetiga texnologik va funksional jihatdan bog\u2018liq bo\u2018lmagan qo\u2018shimcha tovarlarni (ishlarni, xizmatlarni) kiritish)<\/em>\u00a0alomatlari aniqlandi.<\/p>\n<p>Aniqlangan holatlar yuzasidan huquqni muhofaza qilish organlariga va Hisob palatasiga ma\u2019lumotnomalar taqdim etilgan,\u00a0<strong>95<\/strong>\u00a0<strong>ta<\/strong>\u00a0holat buyurtmachilar tomonidan ixtiyoriy bartaraf etilgan,\u00a0<strong>766<\/strong>\u00a0<strong>ta<\/strong>\u00a0holat yuzasidan hududiy boshqarmalar tomonidan\u00a0<strong>267<\/strong>\u00a0<strong>ta<\/strong>\u00a0ish qo\u2018zg\u2018atilib,\u00a0<strong>212 ta<\/strong>\u00a0mansabdor shaxslarga nisbatan tegishli choralar ko\u2018rilgan.<\/p>\n<p><strong>Insofsiz raqobat amaliyotlariga, til biriktirishlar va kartel kelishuvlarga qarshi kurashish<\/strong><\/p>\n<p>Qo\u2018mita markaziy apparati va hududiy boshqarmalar tomonidan o\u2018tgan hisobot davrida insofsiz raqobat holatlari bo\u2018yicha kelib tushgan jami\u00a0<strong>113<\/strong>\u00a0<strong>ta<\/strong>\u00a0murojaatlar O\u2018zbekiston Respublikasi \u201cRaqobat to\u2018g\u2018risida\u201dgi Qonunining 13-moddasiga asosan ko\u2018rib chiqilgan.<\/p>\n<p><strong>57 ta<\/strong>\u00a0murojaat ularni belgilangan tartibda ko\u2018rib chiqish uchun asoslar yetishmasligi sababli ariza egalariga qonunchilik talablari to\u2018g\u2018risida tushuntirishlar berilgan,<strong>\u00a051 ta<\/strong>\u00a0murojaat bo\u2018yicha O\u2018zbekiston Respublikasi Vazirlar Mahkamasining 2005-yil 12-oktabrdagi 225-son qarori bilan tasdiqlangan Raqobat, tabiiy monopoliyalar, iste\u2019molchilarning huquqlarini himoya qilish va reklama to\u2018g\u2018risidagi qonun hujjatlarini buzganlik uchun ish qo\u2018zg\u2018atish va ularni ko\u2018rib chiqish tartibi to\u2018g\u2018risidagi Nizomga asosan\u00a0<strong>54 ta<\/strong>\u00a0ajrim chiqarilgan.<\/p>\n<p>qonunbuzilish alomatlari mavjud bo\u2018lmaganligi sababli\u00a0<strong>17 ta<\/strong>\u00a0ishni qo\u2018zg\u2018atish rad etilgan.<\/p>\n<p>qonunbuzilish alomatlari bo\u2018yicha\u00a0<strong>37 ta<\/strong>\u00a0ish qo\u2018zg\u2018atilgan va belgilangan tartibda ko\u2018rib chiqilgan.<\/p>\n<p><strong>1<\/strong>\u00a0<strong>ta<\/strong>\u00a0murojaat apellatsiya tartibida ko\u2018rib chiqilgan va apellatsiya talabi qanoatlantirilgan.\u00a0<strong>4<\/strong>\u00a0<strong>ta<\/strong>\u00a0murojaat bo\u2018yicha hozirgi kunda oldindan o\u2018rganish ishlari amalga oshirilmoqda.<\/p>\n<p><strong>Tovar va moliya bozorlarida raqobat holati tahlili<\/strong><\/p>\n<p>Tovar, moliya va raqamli bozorlardi o\u2018tkazilgan tahlillar 2023 yil I-yarim yilligi davomida Qo\u2018mita tomonidan jami\u00a0<strong>440 ta<\/strong>\u00a0<em>(markaziy apparat\u00a0<strong>120<\/strong>\u00a0<strong>ta<\/strong>)\u00a0<\/em>tovar va xizmatlar bozorlari tahlil qilindi.<\/p>\n<p>Shundan,<strong>\u00a0134 ta<\/strong>\u00a0<em>(markaziy apparat\u00a0<strong>17<\/strong>\u00a0<strong>ta<\/strong>)\u00a0<\/em>bozorlar to\u2018liq tahlil qilindi,\u00a0<strong>jumladan<\/strong>, elektron hisoblagich, yagona dasturiy texnik kompleksida xizmat ko\u2018rsatish, qurilish oynasi, shisha idish (banka) mineral o\u2018g\u2018itlar, vagon tarozilarini o\u2018rnatish, ta\u2019mirlash va texnik xizmat ko\u2018rsatish, gazbeton ishlab chiqarish, 1,0 m3 hajmli IBC-EUROCUB HDPE mahsuloti ishlab chiqarish, daraxtlarni ko\u2018chirib o\u2018tqazish, qayta ishlangan (boyitilgan) kaolin mahsulotini ishlab chiqarish, temir yo\u2018llari sohasidagi turli xizmatlar bozorlari hamda obyektlarni joylashtirish uchun yer uchastkalarini tanlash bo\u2018yicha kelishish xizmatlari bozorlarida raqobat muhiti holatini baholash\u00a0 ishlari olib borildi.<\/p>\n<p>Tahlil natijalarida\u00a0<strong>3 ta<\/strong>\u00a0korxona\u00a0<strong>2 ta<\/strong>\u00a0tovar va xizmatlar bo\u2018yicha (\u201cToshelektroapparat\u201d MChJ XK va \u201cElektron hisoblagich\u201d MChJ QK elektron hisoblagich realizatsiya qilish bo\u2018yicha hamda \u201cAngren Kaolin\u201d MCHJ boyitilgan kaolin realizatsiya qilish bo\u2018yicha)\u00a0<strong>Davlat reyestriga kiritildi<\/strong>.<\/p>\n<p>Shuningdek,\u00a0<strong>3 ta<\/strong>\u00a0korxona\u00a0<strong>2 ta<\/strong>\u00a0tovar va xizmatlar bo\u2018yicha (\u201cToshkentboshplanLITI\u201d va \u201cO\u2018zshaharsozlikLITI\u201d DUKlar obyektlarni joylashtirish uchun yer uchastkalarini tanlash bo\u2018yicha kelishish xizmati bo\u2018yicha hamda \u201cO\u2018ztemiryo\u2018lkonteyner\u201d AJ vagon tarozilarini o\u2018rnatish, ta\u2019mirlash va texnik xizmat ko\u2018rsatish bo\u2018yicha)\u00a0<strong>Davlat reyestdan chiqarildi.<\/strong><\/p>\n<p>Qo\u2018mita tomonidan ichki bozorning mamlakatimizda ishlab chiqarilgan tovarlar bilan to\u2018linganligini aniqlash maqsadida\u00a0\u00a0<strong>103 ta<\/strong>\u00a0ortiq tovar bozorlarida o\u2018rganishlar o\u2018tkazildi.<\/p>\n<p>O\u2018rganish natijalariga ko\u2018ra,\u00a0<strong>57 ta<\/strong>\u00a0tovar bozorlari mahalliy ishlab chiqaruvchilarning mahsulotlari bilan\u00a0<strong>to\u2018yinganligi<\/strong>\u00a0va\u00a0<strong>46 ta<\/strong>\u00a0tovar bozorining to\u2018yinganlik darajasi pastligi (<strong>to\u2018yinmagani<\/strong>) ma\u2019lum bo\u2018ldi.<\/p>\n<p><strong>Iste\u2019molchilar huquqlarini himoya qilish va reklama faoliyatini tartibga solish sohasida amalga oshirilgan ishlar<\/strong><\/p>\n<p>Hisobot davrida iste\u2019molchilardan jami\u00a0<strong>9 923 ta<\/strong>\u00a0murojaatlar kelib tushgan. Murojaatlarning\u00a0<strong>4 318 tasi (43,5 foiz),\u00a0<\/strong><u>savdo va umumiy ovqatlanish sohasi<\/u><strong>, 3 511 tasi (35,4 foiz)<\/strong>\u00a0<u>uy-joy kommunal, transport xizmatlari<\/u>\u00a0<strong>1 813 tasi (18,3 foiz)<\/strong>\u00a0<u>aloqa, moliya va ijtimoiy xizmatlar<\/u>\u00a0hamda 281 tasi (2,8 foiz)\u00a0<u>reklama munosabatlari<\/u>\u00a0masalalariga to\u2018g\u2018ri keladi.<\/p>\n<p>Mazkur murojaatlarning\u00a0<strong>6 400 tasi<\/strong>\u00a0ijobiy hal etilgan,\u00a0<strong>2 445 tasiga\u00a0<\/strong>tegishli huquqiy tushuntirish berilgan va\u00a0<strong>572 tasi\u00a0<\/strong>vakolatli idoralarga yuborilgan. Ushbu xo\u2018jalik yurituvchi subyektlarining\u00a0<strong>64 tasi<\/strong>\u00a0\u00a0(48 foiz) davlat ishtirokidagi korxonalar hisoblansa,\u00a0<strong>68 tasi<\/strong>\u00a0\u00a0(52 foiz) xususiy sektor hissasiga to\u2018g\u2018ri keladi.<\/p>\n<p>Ushbu reyestrga kiritilgan tabiiy monopoliya subyektlarining ro\u2018yxati Qo\u2018mitaning\u00a0<a href=\"https:\/\/raqobat.gov.uz\/uzb\/%D1%80%D0%B0%D1%81%D0%BC%D0%B8%D0%B9\">https:\/\/raqobat.gov.uz\/uzb\/rasmiy\u00a0<\/a>veb-saytida muntazam ravishda yoritib kelmoqda.<\/p>\n<p><u>II.Tovar yoki moliya bozorida ustun mavqeni egallab turgan xo\u2018jalik yurituvchi subyektlar.<\/u><\/p>\n<p>Joriy yilda Tovar yoki moliya bozorida ustun mavqeni egallab turgan xo\u2018jalik yurituvchi subyektlar davlat reyestriga kiritilgan korxonalardan\u00a0<strong>83<\/strong>\u00a0<strong>ta<\/strong>\u00a0xo\u2018jalik yurituvchi subyektlarning\u00a0<strong>632<\/strong>\u00a0<strong>ta<\/strong>\u00a0to\u2018g\u2018ridan-to\u2018g\u2018ri imzolagan\u00a0<strong>shartnomalari<\/strong>\u00a0o\u2018rganildi,\u00a0<strong>5<\/strong>\u00a0<strong>ta<\/strong>\u00a0monopol korxona tomonidan\u00a0<strong>41<\/strong>\u00a0<strong>ta<\/strong>\u00a0holatda to\u2018g\u2018ridan-to\u2018g\u2018ri shartnomalar tuzishda \u201cRaqobat to\u2018g\u2018risida\u201dgi Qonunining 10-moddasi talablariga\u00a0<strong>rioya qilmaganligi aniqlandi<\/strong>\u00a0va ular bo\u2018yicha belgilangan tartibda ish qo\u2018zg\u2018atilib, kelgusida mazkur qonunchilik talablari buzilishiga yo\u2018l qo\u2018ymaslik bo\u2018yicha\u00a0<strong>ko\u2018rsatmalar<\/strong>\u00a0berildi.<\/p>\n<p><strong>Iqtisodiy konsentratsiya ustidan nazorat<\/strong><\/p>\n<p>Qo\u2018mita va uning hududiy boshqarmalariga xo\u2018jalik yurituvchi subyektlarni qo\u2018shib yuborish va qo\u2018shib olish hamda xo\u2018jalik yurituvchi subyektlarning ustav fondidagi aksiyalarni (ulushlarni) olish yuzasidan jami\u00a0<strong>64 ta<\/strong>\u00a0murojaat kelib tushgan, ulardan 52 tasiga rozilik berilgan, 3 tasi rad etilgan hamda 9 tasi bo\u2018yicha monopoliyaga qarshi organning oldindan roziligi talab etilmasligi bildirilgan.<\/p>\n<p><strong>Monopoliyaga qarshi komplayens tizimini joriy etish<\/strong><\/p>\n<p>Bugungi kunga qadar jami\u00a0<strong>130<\/strong>\u00a0<strong>ta<\/strong>\u00a0shundan,\u00a0<strong>33<\/strong>\u00a0<strong>ta<\/strong>\u00a0tabiiy monopoliya subyektlarida,\u00a0<strong>35<\/strong>\u00a0<strong>ta<\/strong>\u00a0tovar yoki moliya bozorida ustun mavqega ega bo\u2018lgan xo\u2018jalik yurituvchi subyektlarda,\u00a0<strong>37<\/strong>\u00a0<strong>ta<\/strong>\u00a0mahalliy ijro etuvchi hokimiyat organlarida,\u00a0<strong>19<\/strong>\u00a0<strong>ta<\/strong>\u00a0davlat boshqaruvi organlarida hamda\u00a0<strong>6<\/strong>\u00a0<strong>ta<\/strong>\u00a0korporativ buyurtmachilar faoliyatida\u00a0<strong>monopoliyaga<\/strong>\u00a0<strong>qarshi<\/strong>\u00a0<strong>komplayens<\/strong>\u00a0tizimi to\u2018liq\u00a0<strong>joriy<\/strong>\u00a0<strong>etildi<\/strong>.<\/p>\n<p><strong>Tovar-xom ashyo birjalarini litsenziyalash va xarid tizimlarni nazorat qilish<\/strong><\/p>\n<p>Tovar-xom ashyo birjalarida respublikadagi 500 tadan ortiq korxonalar tomonidan 51 turdagi yuqori likvidli va monopol mahsulotlar, xom ashyo va materiallarni belgilangan grafiklar asosida birja savdolariga qo\u2018yilishi yuzasidan doimiy monitoring o\u2018rnatilgan.<\/p>\n<p>Yuqori likvidli va monopol turdagi mahsulotlarning 2023-yil birinchi yarim yilligida sotilgan umumiy hajmi 45,2 trln so\u2018mni (o\u2018tgan yilning shu davriga nisbatan 1 foiz ko\u2018p) tashkil etdi.<\/p>\n<p>2023-yil I-yarim yilligi davomida respublika bo\u2018yicha 32 ta xo\u2018jalik yurituvchi subyekt tomonidan jami 34 ta holatda manipulyatsiya alomatlarini sodir etganligi bo\u2018yicha tegishli choralar ko\u2018rildi. aniqlash bo\u2018yicha<\/em><\/strong><\/p>\n<p>Xo\u2018jalik yurituvchi subyektlarning raqobatni cheklaydigan kelishib olingan harakatlari va kelishuvlari (til biriktirishlar va kartel kelishuvlar) bilan bog\u2018liq 6 ta qonunbuzilish alomatlari aniqlangan, shulardan 4 ta holat bo\u2018yicha tegishli maxsus komissiyalar tomonidan qaror qabul qilingan va qonunbuzilishni bartaraf etish bo\u2018yicha ko\u2018rsatma berilgan va 2 ta holat bo\u2018yicha faoliyatida raqobatni cheklaydigan kelishib olingan harakatlar alomatlari mavjud tadbirkorlik subyektlarining\u00a0<strong>bozordagi ulushi 35 % dan kamligi aniqlangan.<\/strong><\/p>\n<p>Jumladan, Jizzax va Samarqand viloyatlarida faoliyat yuritayotgan avtomaktablarning faoliyatini amalga oshirishda kartel kelishuv holatlarini subyektlarining Davlat reyestriga kiritilgan\u00a0<strong>134 ta<\/strong>\u00a0xo\u2018jalik yurituvchi subyektlar\u00a0<strong>11 ta<\/strong>\u00a0xizmat turlari bo\u2018yicha faoliyatlari ustidan monitoring olib borildi. Ushbu xo\u2018jalik yurituvchi subyektlarining\u00a0<strong>94 tasi<\/strong>\u00a0(70 foiz) davlat ishtirokidagi korxonalar hisoblansa,\u00a0<strong>40 tasi<\/strong>\u00a0(30 foiz) xususiy sektor hissasiga to\u2018g\u2018ri keldi.<\/p>\n<p><strong>2022 yil<\/strong>\u00a0davomida\u00a0<strong>5<\/strong>\u00a0<strong>ta<\/strong>\u00a0xo\u2018jalik yurituvchi subyektlar \u201cAngren IES\u201d va \u201cYangi Angren IES\u201d AJlar, \u201cUzbekistan GTL\u201d MChJ, \u201cNavoiyuran\u201d DK, \u201cVeolia Energy Tashkent\u201d MChJ kabi korxonalar tabiiy monopoliya subyektlarining davlat\u00a0<strong>reyestriga kiritildi,<\/strong>\u00a0<strong>1<\/strong>\u00a0<strong>ta<\/strong>\u00a0\u201cCity building sales\u201d MChJ\u00a0<strong>reyestrdan chiqarildi.<\/strong><\/p>\n<p>Ushbu sohada jami\u00a0<strong>434 ta<\/strong>\u00a0jismoniy va yuridik shaxslarning murojaatlari (shundan\u00a0<strong>345 ta<\/strong>\u00a0yuridik hamda\u00a0<strong>89 ta<\/strong>\u00a0jismoniy shaxslar) ko\u2018rib chiqilib, jami\u00a0<strong>83,9 mlrd so\u2018m\u00a0<\/strong>asossiz daromad olinganligi aniqlandi.<\/p>\n<p><strong>Tabiiy monopoliya<\/strong>\u00a0<strong>subyektlari<\/strong>\u00a0tomonidan tadbirkorlik subyektlari va aholidan asossiz olingan tabiiy gaz \u2013\u00a0<strong>9,3<\/strong>\u00a0<strong>mlrd so\u2018m<\/strong>, elektr energiyasi \u2013<br \/>\n<strong>7<\/strong>\u00a0<strong>mlrd so\u2018m<\/strong>, ichimlik va issiqlik ta\u2019minoti \u2013\u00a0<strong>48,2<\/strong>\u00a0<strong>mlrd so\u2018m<\/strong>, boshqa xizmatlar \u2013\u00a0<strong>1,2<\/strong>\u00a0<strong>mlrd so\u2018m<\/strong>\u00a0mablag\u2018larni qaytarish bo\u2018yicha ko\u2018rsatma berildi. Bugungi kunda\u00a0<strong>17,3<\/strong>\u00a0<strong>mlrd so\u2018m mablag\u2018lar qayta-hisob kitob qilindi.<\/strong>\u00a0Shuningdek, mazkur murojaatlarni ko\u2018rib chiqishda jami\u00a0<strong>16\u00a0930 ta<\/strong>\u00a0iste\u2019molchilarning huquqlarini himoya qilindi.<\/p>\n<p>Tabiiy monopoliya subyektlarining Davlat reyestriga kiritilgan<br \/>\n<strong>134 ta xo\u2018jalik yurituvchi subyektlardan\u00a0<\/strong><strong>129\u00a0<\/strong><strong>tasini<\/strong>\u00a0<strong>250\u00a0<\/strong><strong>turdagi\u00a0<\/strong><strong>ommaviy shartnomalari loyihalari<\/strong>\u00a0tabiiy monopoliya to\u2018g\u2018risidagi qonunchilik hujjatlariga muvofiqligi nuqtai nazaridan ko\u2018rib chiqildi va ulardan\u00a0<strong>150<\/strong>\u00a0<strong>ta\u00a0<\/strong>holatda yoki\u00a0<strong>60\u00a0<\/strong><strong>foizida<\/strong>\u00a0doir qonunchilik talablariga<strong>\u00a0rioya qilmaganligi<\/strong>\u00a0aniqlandi va kamchiliklarni bartaraf etish choralari ko\u2018rildi.<\/p>\n<p><strong>Tabiiy monopoliya<\/strong>\u00a0sohalarini\u00a0<strong>transformatsiya qilish<\/strong>\u00a0yo\u2018nalishida tarmoq infrastrukturasi bilan bog\u2018liq va tabiiy monopoliya sohalarida (elektr energiyasi, tabiiy gaz, transport (temir yo\u2018llari, fuqaro aviatsiyasi va aeroport xizmatlari) va telekommunikatsiya) mustaqil bozor regulyatorlari institutini bosqichma-bosqich joriy etish bo\u2018yicha O\u2018zbekiston Respublikasi Prezidenti qarori loyihasi (ID-70253) ishlab chiqildi va Vazirlar Mahkamasiga kiritildi.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>VII. Iqtisodiy konsentra<\/strong><strong>t<\/strong><strong>siyasi ustidan nazorat hamda monopoliyaga qarshi kompla<\/strong><strong>y<\/strong><strong>ens tizimini joriy etish bo\u2018yicha<\/strong><\/p>\n<p>Bugungi kunga qadar Qo\u2018mita va uning hududiy boshqarmalariga xo\u2018jalik yurituvchi subyektlarni qo\u2018shib yuborish va qo\u2018shib olish hamda xo\u2018jalik yurituvchi subyektlarning ustav fondidagi aksiyalarni (ulushlarni) olish bo\u2018yicha bitimlarga monopoliyaga qarshi organning oldindan roziligini olish yuzasidan jami\u00a0<strong>125 ta<\/strong>\u00a0murojaat kelib tushgan. Shundan,\u00a0<strong>28 ta<\/strong>\u00a0murojaat xo\u2018jalik yurituvchi subyektlarni qo\u2018shib yuborish va qo\u2018shib olishga rozilik olish to\u2018g\u2018risida bo\u2018lsa,\u00a0<strong>97\u00a0tasi<\/strong>\u00a0xo\u2018jalik yurituvchi subyektlarning ustav fondidagi aksiyalarni (ulushlarni) olishga oldindan rozilik olish bilan bog\u2018liq murojaatlar.<\/p>\n<p>Ushbu murojaatlarning\u00a0<strong>92 tasi<\/strong>\u00a0bo\u2018yicha Qo\u2018mita maxsus komissiyasining bitimlarga rozilik berish to\u2018g\u2018risidagi qarori chiqarilgan,\u00a0<strong>30\u00a0tasi<\/strong>\u00a0bo\u2018yicha monopoliyaga qarshi organning oldindan roziligi talab etilmasligi to\u2018g\u2018risida tegishli javob xatlari berilgan, shu bilan birga\u00a0<strong>3\u00a0ta\u00a0<\/strong>holatda ko\u2018rib chiqish to\u2018xtatilgan.<\/p>\n<p>Kelib tushgan barcha murojaatlar chuqur tahlil qilinib, Qo\u2018mita tomonidan jami\u00a0<strong>4\u00a0975<\/strong>\u00a0<strong>mlrd.\u00a0so\u2018mlik<\/strong>\u00a0bitimlarga oldindan rozilik berildi, shundan<br \/>\n<strong>35\u00a0<\/strong><strong>foizi<\/strong>, xo\u2018jaligi, oziq-ovqat<\/strong>\u00a0va shu kabi sohalarga to\u2018g\u2018ridan-to\u2018g\u2018ri mablag\u2018lar va zamonaviy texnologiyalar ko\u2018rinishida investitsiyalar kiritilishi ko\u2018zda tutilgan.<\/p>\n<p>Misol tariqasida olib ko\u2018radigan bo\u2018lsak, hisobot davrida quyidagi bir nechta yirik bitimlarni tuzishga monopoliyaga qarshi organning oldindan roziligi berildi.<\/p>\n<p>Hisobot davrida\u00a0<strong>11<\/strong>\u00a0<strong>ta<\/strong>\u00a0holatda monopoliyaga qarshi organning oldindan roziligini olmasdan xo\u2018jalik yurituvchi subyektlarni kelgusida raqobat to\u2018g\u2018risidagi qonunchilik talablari buzilishiga yo\u2018l qo\u2018ymaslik bo\u2018yicha\u00a0<strong>ko\u2018rsatmalar berildi.<\/strong><\/p>\n<p>Tovar yoki moliya bozorida ustun mavqeni egallab turgan xo\u2018jalik yurituvchi subyektlar davlat reyestriga kiritilgan korxonalar yoki shaxslar guruhi tomonidan ishlab chiqariladigan tovarlarni yetkazib berishda va xizmatlarni ko\u2018rsatishda to\u2018g\u2018ridan-to\u2018g\u2018ri imzolangan shartnomalarning raqobat to\u2018g\u2018risidagi qonunchilik talablariga muvofiq rasmiylashtirilishi yuzasidan tanlanma jadallashtirish chora-tadbirlari to\u2018g\u2018risida\u201dgi PQ-123-son Qaroriga muvofiq Qo\u2018mita va uning hududiy organlari tomonidan Davlat aktivlarini boshqarish agentligi bilan birgalikda hududlar kesimida\u00a0<strong>26\u00a0804<\/strong>\u00a0<strong>ta<\/strong>\u00a0<strong>davlat muassasalarining<\/strong>\u00a0tashkiliy huquqiy shakllarini o\u2018zgartirish va keyingi faoliyati chiqaruvchi Respublikadagi\u00a0<strong>500<\/strong>\u00a0<strong>tadan<\/strong>\u00a0ortiq korxonalar tomonidan\u00a0<strong>51<\/strong>\u00a0<strong>turdagi<\/strong>\u00a0yuqori likvidli va monopol mahsulotlar, xom ashyo va materiallarni belgilangan grafiklar asosida birja savdolariga qo\u2018yilishi yuzasidan hududiy boshqarmalardagi biriktirilgan xodimlar bilan birgalikda doimiy nazorat ishlari olib borilmoqda.<\/p>\n<p>Respublika tovar-xom ashyo birjasida yuqori likvidli va monopol turdagi mahsulotlarning soni joriy yilda\u00a0<strong>38<\/strong>\u00a0<strong>tadan<\/strong>\u00a0<strong>51<\/strong>\u00a0<strong>taga<\/strong>\u00a0yetkazilib, ro\u2018yxatga<br \/>\n<strong>8<\/strong>\u00a0<strong>turdagi<\/strong>\u00a0mahsulot po\u2018lat shar, metall list prokati, suyuq uglerod oksidi, texnik kislorod, kaustik soda, neft koksi, sintetik nafta va barda mahsulotlari kiritildi hamda ushbu ro\u2018yxatdan neft va gaz kondensatlari chiqarildi.<\/p>\n<p>Shu bilan birga, yuqori likvidli va monopol turdagi mahsulotlarning 2022 yilda sotilgan\u00a0<strong>umumiy hajmi 94 trln so\u2018mni\u00a0<\/strong>tashkil etib, 2021 yil mos davriga nisbatan\u00a0<strong>o\u2018sish 31 foizni<\/strong>\u00a0tashkil etgan.<\/p>\n<p><strong><em>Birja savdolari aniqlangan qoidabuzarlik holatlari bo\u2018yicha<\/em><\/strong><\/p>\n<p>Birja savdolarida\u00a0<strong>190 ta<\/strong>\u00a0xo\u2018jalik yurituvchi subyektlar tomonidan manipulyatsiya harakatlarini sodir etganligi va birjaga oid qonunchilik talablari buzilganligi natijasida narxni sun\u2019iy oshishiga sabab bo\u2018lgan<br \/>\n<strong>261 ta<\/strong>\u00a0holat yuzasidan jami\u00a0<strong>92 ta<\/strong>\u00a0xo\u2018jalik yurituvchi subyektlarga ortiqcha olingan jami\u00a0<strong>9 861 mln so\u2018m<\/strong>\u00a0mablag\u2018larni undirish yuzasidan ko\u2018rsatmalar berildi.<\/p>\n<ol>\n<li><strong>Xalqaro munosabatlar va jamoatchilik bilan aloqalar<\/strong><\/li>\n<\/ol>\n<p>Qo\u2018mita va Yevropa tiklanish va taraqqiyot banki (EBRR) o\u2018rtasidagi o\u2018zaro anglashuv memorandumiga binoan, EBRR tomonidan ajratilgan 96 ming yevro miqdoridagi granti asosida \u201cO\u2018zbekiston Respublikasi Monopoliyaga qarshi kurashish qo\u2018mitasining institutsional salohiyatini mustahkamlash\u201d loyihasi doirasida Qo\u2018mita tizimi xodimlari ko\u2018nikma hamda salohiyatini oshirishga qaratilgan\u00a0<strong>3 oylik gibrid<\/strong>\u00a0(onlayn hamda oflayn) tarzda o\u2018quv seminar-treninglar tashkil etilgan.<\/p>\n<p>O\u2018z navbatida, Qo\u2018mita\u00a0<strong>Iqtisodiy hamkorlik va taraqqiyot tashkiloti (OESR)<\/strong>\u00a0bilan hamkorlikda 2021-yil 25-noyabr sanasida start berilgan\u00a0<strong>\u201cRaqobatbardoshlikni ta\u2019minlashning adolatli bozor shartlari\u201d loyihasi<\/strong>\u00a0doirasida salmoqli ishlar amalga oshirib kelmoqda.<\/p>\n<p><em>Ma\u2019lumot uchun:\u00a0<\/em><em>Ushbu loyihasini tatbiq etish uchun\u00a0<\/em><em>OESR\u00a0<\/em><em>tomonidan monopoliyaga va korrupsiyaga qarshi kurashishni ilg\u2018or xalqaro tajribaga muvofiq amalga oshirilishini yo\u2018lga qo\u2018yish maqsadida, dunyoning\u00a0<\/em><strong><em>6\u00a0<\/em><\/strong><strong><em>ta<\/em><\/strong>\u00a0<strong><em>davlatlaridan biri<\/em><\/strong><strong><em>\u00a0etib\u00a0\u00a0<\/em><\/strong><em>O\u2018zbekiston Respublikasi\u00a0<strong>tanlab olingan hamda mazkur\u00a0<\/strong>loyihani tatbiq etish bo\u2018yicha Monopoliyaga qarshi kurashish qo\u2018mitasi muvofiqlashtiruvchi organ etib belgilandi.<\/em><\/p>\n<p>Ushbu loyiha doirasida Qo\u2018mita OESR bilan birgalikda tayyorlangan \u201cO\u2018zbekiston Respublikasi raqobat qonunchiligi hamda siyosatiga kirish\u201d mavzusidagi hisoboti 2022-yil 8-iyun sanasida OESR ekspertlari, bir qator mutasaddi vazirlik va idoralar rasmiylari hamda keng jamoatchilik vakillari ishtirokida \u201cO\u2018zbekiston Respublikasi raqobat qonunchiligi hamda siyosatiga kirish\u201d hisoboti taqdimoti bo\u2018lib o\u2018tdi.<\/p>\n<p>Shu bilan birga, Qo\u2018mita hamda OESR tomonidan 2022-yil 10-12-oktabr kunlari \u201cBozordagi xo\u2018jalik yurituvchi subyektlarining ustun mavqeiy va uni suiiste\u2019mol qilinishi\u201d mavzusidagi seminar-trening hamda 13-oktabr sanasida xalqaro tadbir tashkillashtirildi.<\/p>\n<p><strong>Jahon bankining<\/strong>\u00a0\u201cO\u2018zbekistonda institutsional salohiyatni oshirish\u201d (IBL) loyiha doirasida Qo\u2018mita faoliyati samaradorligini hamda xodimlar salohiyatini oshirish maqsadida yollangan\u00a0<strong>3<\/strong>\u00a0<strong>ta<\/strong>\u00a0xalqaro ekspertlar tomonidan uslubiy tavsiyalar hamda metodikasi ishlab chiqilgan.<\/p>\n<p><strong>AQSh Xalqaro taraqqiyot agentligi (USAID)<\/strong>\u00a0<strong>\u201cMarkaziy Osiyo Energetikasi\u201d loyihasini\u00a0<\/strong>amalga oshiruvchi\u00a0<strong>\u201cTetra Tech\u201d kompaniyasi<\/strong>\u00a0vakillari hamda ekspertlari tomonidan Qo\u2018mita tizimi xodimlari salohiyatini oshirishga qaratilgan tabiiy monopoliya subyektlarini tartibga solish borasida bir qator mavzularda 1-2 haftalik\u00a0<strong>4<\/strong>\u00a0<strong>dan ortiq<\/strong><br \/>\nseminar-treninglar tashkillashtirildi.<\/p>\n<p>Shuningdek, Shveysariya, Tailand, Rossiya Federatsiyasi, Gruziya, Qozog\u2018iston Respublikasi, Qirg\u2018iziston Respublikasi kabi bir qator davlatlarda xorijiy davlatlarning monopoliyaga qarshi kurashish bo\u2018yicha vakolatli organlari, Xalqaro Raqobat Tarmog\u2018i (ICN), BMTning Savdo va Taraqqiyot Konferensiyasi (UNCTAD) hamda xalqaro tashkilotlar tomonidan tashkillashtirilgan monopoliyaga qarshi kurashish hamda iste\u2019molchilar huquqlarini himoya qilish borasida\u00a0<strong>14<\/strong>\u00a0<strong>dan ortiq<\/strong>\u00a0an\u2019anaviy tarzda hamda\u00a0<strong>100<\/strong>\u00a0<strong>ga yaqin\u00a0<\/strong>videokonferens-aloqa rejimida tashkillashtirilgan xalqaro tadbirlarda Qo\u2018mita mutasaddi xodimlari ishtirok etishdi.<\/p>\n<p><strong><em>Integratsiya jarayonlarini jadallashtirish<\/em><\/strong><\/p>\n<p>O\u2018zbekiston Respublikasining Jahon savdo tashkilotiga (JST) qo\u2018shilishi doirasida davlat savdo korxonalari bo\u2018yicha ma\u2019lumot qayta ko\u2018rib chiqildi hamda tegishli qismlari JSTga a\u2019zo mamlakatlar vakillari tomonidan talab etilgan ma\u2019lumotlar bilan to\u2018ldirilgandan so\u2018ng JST kotibiyatiga taqdim etildi.<\/p>\n<p>JSTga a\u2019zo davlatlarning (AQSh hamda Yevropa ittifoqi) tegishli savollariga xalqaro ekspertlar tomonidan taqdim etilgan taklif va izohlardan kelib chiqib javoblar tayyorlandi.<\/p>\n<p>Qo\u2018mita xalqaro ekspertlar bilan birgalikda milliy qonunchilikni JST bitimlariga uyg\u2018unlashtirish maqsadida JST normalariga bitimlariga uyg\u2018unlashtirish rejasini ishlab chiqish bo\u2018yicha ishchi guruhga\u00a0 taqdim etilgan.<\/p>\n<p>Shuningdek, Qo\u2018mita Investitsiyalar va tashqi savdo vazirligi (ITSV) tomonidan jalb etilgan xalqaro ekspertlar Viktor Ognivsev (Shveysariya) hamda Viktor Kroshet (Belgiya) Qo\u2018mita vakolatiga kiradigan masalalar yuzasidan simulyatsion muzokaralar o\u2018tkazildi, shuningdek Qo\u2018mita tomonidan O\u2018zbekiston Respublikasining JSTga qo\u2018shilishi doirasida Ishchi guruhning<br \/>\n6-yig\u2018ilishiga puxta tayyorgarlik ko\u2018rish doirasida tayyorlangan materiallar ko\u2018rib chiqilib, tegishli o\u2018zgartirishlar kiritildi.<\/p>\n<p><strong>Ye<\/strong><strong><em>vroosiyo Iqtisodiy Ittifoqi bilan hamkorlik aloqalarini o\u2018rnatish<\/em><\/strong><\/p>\n<p>O\u2018zbekiston Respublikasi Hukumati va Yevroosiyo iqtisodiy komissiyasi bilan 2021-2023 yillarga mo\u2018ljallangan qo\u2018shma chora-tadbirlar rejasiga muvofiq Qo\u2018mita Yevroosiyo iqtisodiy komissiyasining (EIK) Raqobat va monopoliyaga qarshi tartibga solish bloki bilan hamkorlikda iste\u2019molchilar huquqlarini himoya qilish, tabiiy monopoliyalarni tartib solish, davlat xaridlarini nazorat qilish borasida bir qator chora-tadbirlar amalga oshirildi.<\/p>\n<p>Monopoliyaga qarshi kurashish qo\u2018mitasi tomonidan xalqaro ekspertlar bilan birgalikda O\u2018zbekiston Respublikasining yangi tahrirdagi \u201cRaqobat to\u2018g\u2018risida\u201dgi qonuni loyihasi ishlab chiqilgan.<\/p>\n<p>Mazkur qonun loyihasida YeOII qonunchiligidagi raqobatni rivojlantirish, monopoliyaga qarshi tartibga solish, davlat xaridlarini nazorat qilish hamda tabiiy monopoliyalarni tartibga solish kabi bir qator tegishli normalar O\u2018zbekiston Respublikasining yangi tahrirdagi \u201cRaqobat to\u2018g\u2018risida\u201dgi\u00a0 qonuni loyihasiga kiritilgan.<\/p>\n<p>Shuningdek, Vazirlar Mahkamasiga hamda Investitsiyalar va tashqi savdo vazirligiga Yevroosiyo iqtisodiy ittifoqi to\u2018g\u2018risidagi shartnomaning tegishli qismlarida keltirilgan normalarga milliy qonunchilikni muvofiqlashtirish bo\u2018yicha tahliliy materiallar hamda takliflar yuborilgan.<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><strong>Iste\u2019mol bozorlarida narxlarni monitoring qilish Prezidentining 2022-yil 31-maydagi<br \/>\nPF-145-son Farmoniga asosan aholini asosiy turdagi oziq-ovqat va zarur mahsulotlar bilan ta\u2019minlashni tashkil etish, ularning xavfsizligi va sifatini tizimli nazorat qilish hamda mahsulotlar narxlarining barqarorligini ta\u2019minlash maqsadida Vazirlar Mahkamasining 2022-yil 19-dekabrdagi 716-son qaroriga asosan Iste\u2019mol bozorlarida narxlarni monitoring qilish departamentiga bir qator qo\u2018shimcha vazifa va vakolatlar berildi.<\/p>\n<p>Farmonda belgilangan vazifalar ijrosi yuzasidan quyidagilar amalga oshirilmoqda.
