Based on the results of consideration of the case No. 12\/6 dated 30.01.2020 by the Special Commission of the Committee, Kibray “SHAROB has been instructed to stop and prevent further violations of the Law.<\/p>\n

Based on the results of the review of the case No. 12\/12 of 12.02.2020 by the Special Commission of the Committee, \u201cGreen Desert\u201d LLC was instructed to stop the violation and prevent further violations.<\/p>\n

LLC \u201cGreen Desert\u201d reported that the instruction was executed on 12.03.2020.<\/td>\n

6<\/td>\n\u00ab<\/strong>Dentafill<\/strong> Plyus<\/strong>\u00bb<\/strong> LLC<\/strong><\/td>\nPart 2 of the Law “On competition”<\/td>\nLLC \u00abDentafill Plyus\u00bb registered trademarks for Galaxy toothpaste which were similar to Colgate-Palmolive Company\u2019s (USA) Colgate toothpaste registered in Uzbekistan in terms of font, color combination, graphic spelling. \u00abDentafill Plyus\u00bb LLC appealed to the District court against the decision made by the Special Commission of the Committee on the results of the case No. 12\/14.<\/p>\n

By the decision of the Shaykhantakhur district administrative court dated 04.06.2020, the decision of the special commission remained in force.<\/td>\n

\"\"<\/a><\/td>\n<\/tr>\n
7<\/td>\n\u00ab<\/strong>Medilux<\/strong> Pharma<\/strong>\u00bb<\/strong> LLC<\/strong><\/td>\nArticle 13 of the Law “On competition”, Paragraph 3.<\/td>\nMisleading of AMPISUL trademark of LLC \u00abPHARM ABIDI INT\u00bb to AMPSUL, \u00abMedilux Pharma\u00bb LLC. The designation was found to sound-like the registered trademark.<\/p>\n

Based on the results of consideration of the case No. 12\/15 \u00abMedilux Pharma\u00bb LLC was instructed to stop the violation and prevent further violations.<\/p>\n

\u00abMedilux Pharma\u00bb LLC reported that the instruction was executed on 20.03.2020.<\/td>\n

8<\/td>\n\u00ab<\/strong>SERENE PHARMA<\/strong>\u00bb<\/strong> LLC<\/strong><\/p>\n

Article 13 of the Law “On competition”, Paragraph 3.<\/td>\nThe trademark “Kids COLOSTRUM” of BFQ, produced by LLC \u00abSERENE PHARMA\u00bb, was found to be similar in sound to the previously registered trademark “KOLOSTRUM \/ COLOSTRUM” for BFQ of the same composition of LLC “LUX SUNRISE PHARMA”.<\/p>\n

Based on the results of consideration of the case No. 12\/18 dated 06.03.2020 by the Special Commission of the Committee, LLC \u00abSERENE PHARMA\u00bb was instructed to stop the violation and prevent further violations. LLC \u00abSERENE PHARMA\u00bb has complied with the instructions.<\/span><\/td>\n

\"\"<\/a><\/td>\n<\/tr>\n
9<\/td>\n\u00ab<\/strong>MEDIOFARM<\/strong>\u00bb<\/strong> LLC <\/strong><\/td>\nArticle 13 of the Law “On competition”, Paragraph 3.<\/td>\nThe trademark “MILDROMED” related to \u00abMEDIOFARM\u00bb LLC previously registered for drugs of the same composition by the company “GRINDEKS, Akciju Sabiedriba” (Latvia). \u00abMILDPON\u00bb was found to be similar to “MILDROMED”.<\/p>\n

Based on the results of consideration of the case No. 12\/23 dated 01.07.2020 by the Special Commission of the Committee, LLC \u00abMEDIOFARM\u00bb was instructed to stop the violation and prevent further violations.<\/p>\n

LLC \u00abMEDIOFARM\u00bb complied with the instructions.<\/td>\n

Based on the results of consideration of the case No. 12\/36 dated 21.08.2020 by the Special Commission of the Committee, \u201cUSTA XASAN QANDOLATCHI\u201d LLC was instructed to stop the violation and prevent further violations.<\/td>\n

Article 13 of the Law “On competition”, Paragraph 3 and 4<\/td>\n\u00abHIMOLIFE\u00bb designation used by \u201cSHAMS MEHNAT OBOD BARAKA\u201d LLC was found to be misleading to the \u00abHYDROLIFE\u00bb trademark registered in the name of \u00abHYDROLIFE BOTTLERS\u00bb LLC.<\/p>\n

Based on the results of consideration of the case No.05\/03 dated 11.02.2020 by the Special Commission of the Bukhara Regional Territorial Department, \u201cSHAMS MEHNAT OBOD BARAKA\u201d<\/strong> LLC <\/strong>was instructed to stop and prevent further violations. However, due to non-compliance with the instructions, the department sent all the documents to the court to take action in accordance with the requirements of Article 178 of the Code of Administrative Liability.<\/td>\n

Article 13 of the Law “On competition”, Paragraph 3 and 4<\/td>\n\u201cTerlaFlu\u201d word elements produced used by \u201cMERRYMED \u0492ARM\u201d LLC was found to have a sound (phonetic) similarity, ideological similarity and color combination to the \u201cTHERAFLU” brand.<\/p>\n

Based on the results of consideration of the case No. 02\/1 dated 12.02.2020 by the Special Commission of the Namangan Territorial Department, LLC \u201cMERRYMED \u0492ARM\u201d was instructed to stop and prevent further violations.<\/td>\n

The Koniferan SP trademark of the biologically active additive manufactured by BIONORISA SE has been found to be at a level of misleading to the Kanefron trademark.<\/p>\n

According to the results of consideration of the case No. 02\/11 dated 06.07.2020 by the Special Commission of the Namangan Regional Department, SHAMS MEHNAT OBOD BARAKA LLC was instructed to stop the violation and prevent further violations. The Company announced its termination of use of this trademark in its response letter No. 19 dated 04.08.2020.<\/td>\n

14<\/td>\n\u201cMetal service invest\u201d LLC<\/strong><\/p>\n

Article 13 of the Law “On competition”, Paragraph 3<\/td>\n\u201cMetal service invest\u201d LLC<\/p>\n

purchased previously used packaging boxes of the \u00abMEXMASH\u00bb brand, registered in the name of \u00abMexmash\u00bb LLC from waste paper collection points, and sold its products in these packaging boxes.<\/p>\n

According to the results of consideration of the case No. 01-05\/03 dated 16.06.2020 by the Special Commission of the Fergana Regional Territorial Department, \u201cMetal service invest\u201d LLC was instructed to stop and prevent further violations.<\/p>\n

A response letter dated 02.07.2020 was issued stating that the Company had complied with the requirements of the instruction.<\/td>\n

15<\/td>\n\u201cChimyon obihayot\u201d <\/strong>LLC<\/strong><\/p>\n

Article 13 of the Law “On competition”, Paragraph 4<\/td>\nThe trademark \u201cFINALLY\u201d in the product manufactured by \u201cChimyon obihayot\u201d LLC has used a designation \u201cFINALLY\u201d which was found to be similar with the \u201cFAMILY\u201d trademark given to \u201cFamily group\u201d LLC.<\/p>\n

According to the results of the case initiated by the Special Commission of the Fergana Regional Department No. 01-05\/15dated 14.09.2020, Chimyon Obihayot LLC was instructed to stop the violation and prevent further violations.<\/p>\n

Article 13 of the Law “On competition”, Paragraph 3<\/td>\n\u201cShirin Asal Food\u201d LLC was found to be misleading using \u201cBAYAN SULU\u201d designation with \u201cBAYAN SULU\u201d trademark of \u201cBayan Sulu\u201d JSC (Kazakhstan).<\/p>\n

Based on the results of consideration of the case No. 04\/09 dated 23.06.2020 by the Special Commission of the Tashkent City Territorial Department, the relevant instructions were given to LLC \u201cShirin Asal Food\u201d to stop and prevent further violations.<\/td>\n

17<\/td>\nLLC<\/strong> \u201cRAKATBOSHI TAOMLARI\u201d <\/strong><\/p>\n

Article 13 of the Law “On competition”, Paragraph 3<\/td>\nThe designation \u201cUZBEGIM taamlari\u201d used by \u201cRAKATBOSHI TAOMLARI\u201d <\/strong>LLC<\/strong> is considered to be similar to the trademark \u201cUZBEGIM\u201d owned by \u201cMavlono-Star\u201d LLC.<\/p>\n

Based on the results of consideration of the case No. 04\/10 dated 29.06.2020 by the Special Commission of the Tashkent City Territorial Department, the relevant instructions were given to LLC<\/strong> \u201cRAKATBOSHI TAOMLARI\u201d <\/strong>to stop the violation and prevent further violations.<\/p>\n

However, due to non-compliance with the requirements of the instruction, the Board extended the execution of the instruction until 31.08.2020, based on the requirements of paragraph 11 of Article 271 of the Code of Administrative Responsibility. However, the department was not informed about the implementation of the instruction.<\/p>\n

Currently, the issue of bringing to administrative responsibility the officials of LLC<\/strong> \u201cRAKATBOSHI TAOMLARI\u201d<\/strong> is being considered.<\/td>\n
